Terms and conditions apply
All goods, services and work supplied by the identified Corse Customs Seller are subject to these Terms when properly incorporated into the transaction. Electronic acceptance may be used and no handwritten signature is generally required. SPECIAL ORDERS are generally not eligible for change-of-mind cancellation after supplier commitment. Delivery estimates may vary. Please read prominently disclosed limitations and risk provisions before accepting.
SPECIAL ORDERS are procured specifically for the Customer and cannot be cancelled or returned for change of mind once ordered from the supplier. Delivery dates are estimates.
Clauses printed in bold limit the Seller’s liability or place risk or obligations on the Customer: please read them carefully.

1.1These Sales Terms and Conditions ("Terms") apply to goods and services supplied by the legal entity named as Seller on the relevant quotation, job card, order confirmation or tax invoice. They are adopted for use by Corse Customs (Pty) Ltd, Corse Customs Automotive (Pty) Ltd and Corse Customs DST (Pty) Ltd, and by any other group entity that expressly adopts them in its own name. Trading divisions may include Corse Moto Art, QJ Motors Sandton and Point 99 where operated by the identified Seller. These Terms apply when properly incorporated into the relevant agreement.
1.2 The company named on the quotation, job card, order confirmation or tax invoice is the “Seller” for that transaction. Each company contracts separately, and no other group company is liable for the Seller’s obligations unless it agrees so in writing.
1.3 In these Terms:
(a)“Customer” means the person or entity that requests a quotation, places an order, books work or accepts an Order;
(b)“Goods” means all products, including wheels, tyres and fitment hardware, motorcycles, motorcycle and vehicle parts, performance components, accessories, helmets, apparel and protective equipment, whether held in stock or imported;
(c)“Services” means fitment, installation, workshop, repair, maintenance, paint, finishing, customisation, fabrication, advice, import facilitation, delivery and any other work;
(d)“Custom Work” means Services performed to a specification, design, colour or finish requested or approved by the Customer;
(e)“Special Order Goods” has the meaning in clause 5.1, and “Stock Goods” means Goods held in the Seller’s stock and not procured for the Customer;
(f)“Order” means any quotation, order, job card or online order accepted under clause 2;
(g)“Supplier Commitment” means the time the Seller places an order with, or makes payment to, a manufacturer, distributor or supplier for Goods for the Customer;
(h)“Consumer” means a Customer protected by the Consumer Protection Act 68 of 2008 (“CPA”), and “Business Customer” means a Customer to whom the CPA does not apply.
1.4 These Terms are subject to the CPA, the Electronic Communications and Transactions Act 25 of 2002 (“ECTA”) and other mandatory law where they apply. Nothing in these Terms limits any right that cannot lawfully be excluded, and these Terms must be interpreted accordingly.
1.5 Vehicle consignment and new-vehicle sales may be governed by a separate written agreement. These Terms apply to those transactions to the extent they are consistent with that agreement.
1.6 These Terms prevail over any terms proposed by the Customer. They may be varied only in writing by the Seller.
Acceptance — No Signature Required
2.1An Order is accepted when the Seller confirms acceptance after the Customer has been provided these Terms and the applicable material conditions have been properly brought to the Customer's attention. Acceptance may be recorded by:
(a)the Customer ticking the acceptance box or selecting the acceptance option at online checkout;
(b)the Customer accepting a quotation, order or job card, or instructing the Seller to proceed, by email, WhatsApp, SMS, social media message or other recorded electronic communication, including a recorded instruction to undertake work; or
(c)the Customer paying a deposit or other amount against a quotation, order, job card or invoice after receiving these Terms and the applicable transaction conditions.
2.2A handwritten signature is not generally required for an electronic agreement. Electronic acceptance, a recorded instruction or payment may evidence agreement where the Customer was given reasonable advance access to these Terms and the transaction-specific conditions. Neither payment nor a message automatically proves acceptance of undisclosed terms.
2.3The Seller will make these Terms available before the Customer places an Order or authorises work, by a link or attachment on the quotation, job card, checkout or order confirmation. Any material limitation of liability, indemnity, assumption of risk or unusual term will be highlighted as required by law. The Seller will retain evidence of the version provided and the Customer's acceptance.
2.4 The Seller may decline an order before Supplier Commitment or before starting work, in which case any amount paid will be refunded in full.
Quotations, Prices And Specifications
3.1 Quotations are valid for 7 days unless stated otherwise, and are subject to stock availability and supplier confirmation.
3.2 Prices are in South African Rand and include VAT unless stated otherwise. The quotation will state any freight, insurance, customs, fitment or other charges.
3.3Prices of imported Goods are based on supplier pricing, currency, freight and duties at the quotation date. Before an Order is accepted, the Seller may issue a revised quotation. After acceptance, a fixed price will not be changed unilaterally. Any lawful, previously disclosed adjustment mechanism or subsequent price change must be clearly explained and expressly accepted by the Customer before it becomes binding. Where the parties cannot agree a proposed change, their cancellation and refund rights are determined by the Order and applicable law.
3.4The Customer must check and approve product descriptions, part numbers, size, specification, colour, finish and quantity and, where relevant, vehicle make, model, year, variant and VIN. Where the Customer independently selects specifications, the Seller may rely on accurate Customer information, but remains responsible for any fitment advice, selection or verification it undertakes and its duties of reasonable care and skill.
3.5 Changes requested after Supplier Commitment or after work has started require the Seller’s written agreement and may change the price and lead time.
Payment
4.1 Special Order Goods and imported Goods must be paid for in full before Supplier Commitment, unless the Seller agrees in writing to accept a deposit. Any balance must be paid before the Goods are released.
4.2 Stock Goods must be paid for before collection or delivery.
4.3 Services and Custom Work require the deposit stated on the quotation or job card, with the balance payable on completion and before release of the vehicle or goods.
4.4 Payment is made only when cleared funds reflect in the Seller’s account. The Seller is not obliged to release any Goods, vehicle or item until all amounts due for it have been paid in full.
4.5 Business Customers with an approved credit account must pay in accordance with their account terms, and clause 14 applies to overdue amounts.
Special Orders
5.1 Special Order Goods are Goods that the Seller procures, imports, manufactures, configures or alters specifically to satisfy the Customer’s requirements, including for an identified vehicle, size, specification, colour or finish. They include OZ Racing, MSW, Sparco and other specialist wheels, motorcycle- and vehicle-specific parts and performance components, specially requested helmets, apparel and accessories, and any Goods not held in the Seller’s stock that are ordered for the Customer.
5.2Special Order Goods will be identified as such on the quotation, order confirmation or checkout. Before procurement, the Seller will disclose the transaction-specific specifications, special-order terms and material conditions to the Customer and retain a record of acceptance by one of the methods in clause 2.1. Mandatory statutory disclosures and rights remain applicable.
5.3Once the Seller confirms the Customer's order and places the corresponding purchase order with the manufacturer, distributor or supplier ('Supplier Commitment'), the qualifying Special Order is a binding customer-specific procurement commitment. Correctly supplied goods cannot be cancelled or returned merely because the Customer changes their mind, sells the vehicle, abandons the project, finds a lower price or no longer requires the item. This applies whether the goods are still at the supplier, being manufactured, in transit, awaiting Customs and Excise clearance or already delivered. Mandatory statutory cancellation and other rights remain unaffected.
5.4If the Seller voluntarily agrees to cancellation after Supplier Commitment, it may propose a reasonable, itemised charge reflecting supplier commitments, freight, customs, administration and genuine unrecovered losses, on terms accepted in writing before cancellation. No cancellation or restocking charge under this clause applies where the Customer is entitled by law to a cancellation or refund without such charge. Any charge for a statutory cancellation is governed strictly by the applicable law.
5.5Before Supplier Commitment, a Customer may request cancellation by written notice. Any lawful deduction or refund will be determined under the applicable contract and legislation; no automatic forfeiture applies.
5.6The Seller has no obligation to accept correctly supplied Special Order Goods back into stock or to seek an alternative buyer, particularly where OZ Racing, MSW, Sparco or motorcycle-specific products have limited compatible applications or cannot be returned to their overseas supplier. The Seller may nevertheless, solely at its commercial discretion, offer a voluntary return or cancellation under the separate Returns Policy, subject to written agreement and an ordinarily proposed minimum 25% handling/restocking fee where reasonable and lawful. No such fee applies to a statutory return for which a charge is prohibited.
5.7 The Customer acknowledges that vehicle-specific Goods, including wheels selected for a particular diameter, width, offset, PCD, centre bore, load rating, brake clearance and finish, may not fit any other vehicle and may have little or no resale market.
Custom Work, Fitment And Workshop Services
6.1Before performing repair, maintenance or fitment work, the Seller will comply with any applicable estimate and pre-authorisation requirements. Its written or recorded estimate/job card will identify the work, itemised anticipated charges, quotation validity, expected completion or collection period and collection/storage consequences, or record a lawful waiver or a maximum pre-authorised amount.
6.2Custom Work is carried out to Customer-approved specifications, designs, colours and finishes. Approval of drawings, digital images, samples and changes may be recorded electronically. Reasonable variations disclosed and accepted in advance do not by themselves establish a defect; defective workmanship or failure to meet the agreed specification remains subject to statutory remedies. After work commences, any cancellation and payment for work and materials will be handled in accordance with the agreement and applicable law.
6.3 If further work or cost is identified during a job, the Seller will stop and obtain the Customer’s approval before continuing.
6.4 The Seller is not responsible for the quality, fitness or fitment of parts or materials supplied by the Customer or a third party, or for delays they cause, except where loss or damage results from the Seller’s negligence.
6.5 The Customer must disclose known damage, faults and modifications to the vehicle or goods. The Seller may record the condition of a vehicle or goods, including by photograph, when it is received.
6.6 The Seller will take reasonable care of vehicles and goods in its possession. The Customer must remove personal belongings and valuables, and the Seller is not responsible for undeclared items left in a vehicle except where it is negligent.
6.7 The Customer authorises the Seller’s staff to move and road-test a vehicle as reasonably necessary for the work.
6.8Where legally entitled, the Seller may assert a valid lien or other lawful right of retention over goods or a vehicle for amounts properly due in relation to the work performed. Storage and other charges must have a lawful, disclosed basis. No automatic right to sell the Customer's property arises from this clause.
6.9 Services, and parts installed, carry the warranty provided by the CPA where it applies.
Delivery, Lead Times And Imports
7.1Before confirmed dispatch, production and delivery lead times are indicative estimates unless an expressly binding date or fulfilment period is agreed. A tracking number generally permits a carrier-supported delivery forecast; it is not a guarantee of customs clearance or final delivery on a particular date. Any agreed fulfilment period, particularly for online Orders, remains legally relevant.
7.2Imported Goods depend upon manufacturers, suppliers, airlines, carriers, freight forwarders, customs agents, SARS Customs and Excise and other authorities. Delays may exceed 21 days, particularly during conflict, airspace closures or regulatory examination. Express or air freight describes a transport service, not an unconditional delivery guarantee. The Seller will take reasonable steps to place and monitor the order, facilitate customs clearance, mitigate material delays and keep the Customer informed. Freight refunds are governed by the contract, service actually rendered and applicable law.
7.3Events genuinely beyond the Seller's reasonable control (including war, sanctions, flight disruption, customs holds, government measures and extraordinary supplier interruption) may affect its ability to perform. The Seller will notify the Customer of material effects, take reasonable mitigation steps and propose revised arrangements. Relief or suspension applies only to the extent permitted by the contract and law; the Seller remains responsible for its own fault and mandatory obligations.
7.4A change in an indicative transport or supplier estimate does not, without more, establish that the Seller is at fault. However, a statutory or binding contractual right arising from late delivery, non-performance or unavailability remains enforceable. The Seller will not rely on an automatic 90-day extension or an indefinite sequence of revised estimates to defeat such a right. The parties may agree revised delivery arrangements in writing, without waiving mandatory protections.
7.5For online Orders, the order confirmation must distinguish the agreed execution/fulfilment period from an estimated carrier arrival date. If no alternative period was agreed, ECTA section 46 generally requires execution within 30 days; where applicable, the Customer retains the statutory right to cancel on seven days' written notice if the agreed or statutory execution period is missed, as well as statutory rights where goods are unavailable.
7.6 The Customer should inspect Goods on delivery or collection and report any visible damage or shortage promptly, preferably within 48 hours. This does not limit the Customer’s statutory rights.
Risk And Ownership
8.1 Risk in Goods passes to a Consumer on delivery to, or collection by, the Consumer or the Consumer’s nominated carrier. Risk passes to a Business Customer on dispatch from the Seller’s premises or handover to a carrier.
8.2 Ownership of Goods remains with the Seller until the price has been paid in full. Until then, the Customer may not sell, pledge or otherwise dispose of the Goods, and the Seller may recover them to the extent permitted by law.
Uncollected Goods And Vehicles
9.1 The Seller will notify the Customer in writing, including by email or WhatsApp, when Goods are ready for collection or work is complete.
9.2Where an agreed collection period expires and the Customer has received a clear notice, reasonable storage charges may apply only if their rate and basis were disclosed and lawfully agreed in advance. The Seller will provide a further reminder where practical.
9.3Uncollected goods and vehicles will be held and dealt with in accordance with applicable law. The Seller will not sell, transfer, scrap or dispose of Customer-owned property merely because a contractual period has expired; it will first establish any lawful lien, abandonment, statutory process, court authority or other legally valid basis and provide notices required by law.
Defects, Returns And Warranties
10.1 PRODUCT SPECIFICATION, QUALITY AND CONFORMITY. All products imported or made available by the Seller for distribution are selected and supplied against their applicable manufacturer specifications, approved product descriptions and intended vehicle or product applications. The Seller sources genuine products from approved manufacturers, distributors and suppliers and does not knowingly offer or supply unsafe, defective, counterfeit or nonconforming goods. Product fitment and application details recorded in a Customer order determine the agreed specification. Any credible concern about manufacturing defects, incorrect supply, safety or conformity will be assessed promptly, with supplier or manufacturer technical assistance where appropriate. Mandatory statutory rights, including those under sections 55 and 56 of the Consumer Protection Act where applicable, remain unaffected.
10.2CHANGE OF MIND DISTINGUISHED FROM PRODUCT QUALITY. A Customer changing their mind, selling the vehicle, finding an alternative product or deciding not to use correctly supplied goods does not, without more, constitute a defect, nonconformity or contractual ground to cancel a qualifying Special Order after Supplier Commitment. Voluntary returns and exchanges are governed by the Corse Customs Group Returns, Refunds and Exchanges Policy, made available before purchase and incorporated into these Terms. That policy distinguishes non-interchangeable Special Orders from potentially resalable goods such as standard levers, helmets and apparel. Nothing in it limits mandatory statutory rights.
10.3For a discretionary return, Goods must normally be unused and in saleable condition, with original packaging, labels and accessories. Wheels with tyres mounted or damaged during fitting, altered components, and helmets or protective gear showing impact or riding use may be refused as voluntary returns. Reasonable fitting for sizing is not automatically disqualifying. These conditions do not limit defect, safety, online cooling-off or other statutory rights.
10.4 To the extent permitted by law, warranties do not cover damage caused by installation by others, impact, kerbing, accidents, misuse, competition or track use, incorrect tyre pressure, harsh chemicals or cleaners, or normal wear and tear.
10.5MANUFACTURER WARRANTIES. Every product imported for distribution and made available for sale by the Seller is supplied with the applicable manufacturing warranty offered by its manufacturer for that specific product, subject to the scope, duration, conditions and exclusions of that warranty. The Seller will honour and administer valid manufacturer-warranty claims for products it has supplied, including arranging assessment with the relevant manufacturer or its authorised representative and implementing the applicable warranty remedy. Product-specific warranty terms and relevant usage, installation and maintenance conditions will be made available on request and, where required by law, before sale. Manufacturer warranties supplement and do not replace any mandatory rights or remedies under South African law. Manufacturer assessment does not suspend or override a statutory remedy owed by the Seller. Where applicable, section 57 of the Consumer Protection Act also governs warranties relating to repaired goods and newly installed or reconditioned parts. Helmets and protective equipment must be used and maintained in accordance with manufacturer instructions; no equipment eliminates every risk of injury.
Fitment, Performance And Race Components
11.1The Customer or their independent installer should inspect wheels and parts and confirm application before permanently modifying them or mounting tyres, where reasonably practicable. The Seller is responsible for any fitment service or advice it undertakes, and is not automatically responsible for negligent work by an unrelated third-party installer. Applicable product and service rights remain unaffected.
11.2 Some performance and competition components are intended for closed-course use and may affect road legality, emissions compliance, roadworthiness, warranties and insurance. The Seller will identify race-only components where applicable, but does not warrant that they are suitable or lawful for public-road use. The Customer is responsible for compliance and for informing the Customer’s insurer.
Online Orders
12.1Electronic Orders are subject to ECTA where applicable. Before checkout the Seller will provide mandatory supplier identity and contact information, material product particulars, the full price and charges, delivery or execution period, returns terms, and an opportunity to review, correct and withdraw the order. The Customer must be able to store or reproduce the applicable Terms.
12.2Where section 44 of ECTA applies, the Consumer may cancel qualifying goods purchases within seven days after receipt without a penalty, generally bearing only the direct return cost. Statutory exclusions include goods made to Customer specifications or clearly personalised; importing a catalogue item on request does not alone prove that an exclusion applies. Section 43 compliance and section 46 fulfilment rights also apply where relevant.
12.3 The Seller keeps an electronic record of each online acceptance, including the date, time and version of these Terms accepted. That record is proof of acceptance unless the contrary is shown.
Limitation Of Liability
13.1Subject to the CPA and other applicable law, the Seller does not guarantee independent supplier, airline or customs schedules and will not be responsible solely because an external provider causes a delay that the Seller could not reasonably prevent. Any contractual exclusion of indirect loss applies only where lawful, reasonably drawn to the Customer's attention, and does not exclude remedies for the Seller's own breach, negligence or a mandatory statutory obligation.
13.2The Customer is responsible for inaccurate or incomplete vehicle or fitment information supplied by the Customer to the extent that it causes loss, but not to the extent a loss results from the Seller's negligent advice, verification, installation or other conduct. Any indemnity is restricted to loss caused by the Customer and subject to applicable law.
13.3Nothing in these Terms excludes liability for gross negligence, personal injury or damage where exclusion is prohibited, a mandatory product-safety remedy, or any other liability that cannot lawfully be excluded. Limitations and material risk allocations must be prominently disclosed where required.
Business Customers
14.1The provisions below apply only insofar as the CPA and other mandatory consumer laws do not apply to the particular Business Customer or transaction. Any separate signed trade-credit agreement takes precedence where expressly agreed:
(a)no Order may be cancelled after acceptance without the Seller’s written consent;
(b)the Seller’s total liability is limited to the price paid for the Goods or Services concerned, and all warranties not expressly given in writing, including the warranty against latent defects, are excluded to the extent permitted by law;
(c)overdue amounts bear interest at the prime lending rate of the Seller’s bank plus 2% per year, calculated daily and compounded monthly, from the due date until paid;
(d)the Customer is liable for all legal and collection costs on the attorney-and-own-client scale, including tracing fees and collection commission;
(e)the Customer consents to the jurisdiction of the Magistrates’ Court, irrespective of the amount claimed;
(f)a certificate signed by a director of the Seller stating the amount owing is prima facie proof of that amount; and
(g)the person accepting an Order on behalf of the Business Customer warrants that they are authorised to do so.
Personal Information
15.1 The Seller processes personal information, including names, contact details, identity numbers where required for customs, and vehicle and VIN details, in accordance with the Protection of Personal Information Act 4 of 2013. It uses this information to quote, process and fulfil Orders, import and clear Goods, administer warranties, and comply with legal obligations.
15.2The Seller may share only such personal information as is reasonably required with suppliers, carriers, customs agents, SARS and service providers for the stated purposes, subject to applicable privacy law. The Seller will provide its privacy notice and a lawful marketing opt-out mechanism.
Complaints And General
16.1 Complaints must be sent in writing to the Seller. Nothing in these Terms prevents a Consumer from approaching an applicable ombud, regulator, tribunal or court.
16.2 These Terms are governed by the law of the Republic of South Africa.
16.3 The Seller’s address for notices and legal process is 183 Rivonia Road, MiCity Parkade Level 2, Sandton, 2057. The Customer’s address is the physical, email or WhatsApp contact details given to the Seller. Notices by email or WhatsApp are valid written notice.
16.4 The Order and these Terms are the entire agreement between the parties. The version of these Terms in force when an Order is accepted applies to that Order, and the Seller may update these Terms for future Orders.
16.5 Any invalid provision is severable, and the rest of these Terms remain in force. No indulgence or delay by the Seller is a waiver of its rights.
